New trademarks

Every week, a precursory glance through the USPTO’s trademark database reveals a number of new noteworthy trademarks. Last week was no exception, so we will use this space to highlight either recent filings or registrations at the USPTO.

  • COVFEFE

  • Applicant: BWBC, Inc.

  • Application Date: June 2, 2017

  • Serial Number: 87/472771

  • Goods and Services: International Class 032, G & S: Beer

  • COVFEFE COFFEE

  • Applicant: Kenneth L. Gallman

  • Application Date: May 31, 2017

  • Serial Number: 87/469292

  • Goods and Services: International Class 030, G & S: Coffee and coffee substitutes; International Class 043, G & S: Coffee-house and snack-bar services

  • COVFEFE CARRY ON VIGILANTLY FIGHTING EVIL FOR EVER

  • Applicant: Patrick Thompson

  • Application Date: June 1, 2017

  • Serial Number: 87/471677

  • Goods and Services: International Class 035, G & S: use in sales of a variety of apparel, mugs, bumper stickers, and other merchandise

In the weeks following President Trump’s now-deleted tweet, over twenty trademark applications have been filed pertaining to “covfefe.” Many simply are word marks for COVFEFE; meanwhile, two applications have been filed for both COVFEFE COFFEE and #COVFEFE, and one application attempts to make COVFEFE into an acronym.

Unsurprisingly, none of the applicants have a connection to the President. Unless the President was able to make a valid use in commerce of COVFEFE third-parties may have a possible claim to rights in the mark by others willing to invest in registration and use in commerce of the mark.
